Case-law by the Court of Justice of the European Union on the European Investigation Order
The first comprehensive overview of the case-law of the Court of Justice of the European Union (CJEU) relating to the European Investigation Order (EIO) brings together all relevant judgments delivered by the CJEU to date, offering a structured and accessible reference tool for legal practitioners and judicial authorities involved in cross-border criminal investigations.
Since its introduction, the EIO has become a cornerstone of judicial cooperation in criminal matters across the EU, enabling the swift and efficient gathering of evidence between Member States. However, the practical application of the EIO has raised complex legal questions, many of which have been clarified through CJEU rulings.
This overview provides:
- A systematic summary of the Court’s case-law organised by key topics, following the structure of Directive 2014/41/EU; and
- A chronological list of judgments and pending cases.
By consolidating and analysing the evolving jurisprudence, this publication aims to enhance the consistent application of the EIO and contribute to a more effective system of judicial cooperation within the EU.
